Development Management: Schedule of modifications

Representation ID: 34377

Received: 22/09/2014

Respondent: Ms G Yeadell

Representation Summary:

I strongly object to the proposed deletion of para 2.45, page 27 which had outlined the need for detailed lighting schemes to accompany all full planning applications. It is apparent that the Clean Neighbourhoods and Environment Act 2005 is being flouted.
The executive mansion development referred to in my comments on Modification MM5 got away with 8 10' high lampstands, on all night, shining into neighbouring bedroom windows all night, necessitating erecting boards and counterpanes to exclude the light. This was done 2003-4, before the Act and officials claimed 'the lampposts are acceptable in planning terms, but we are not responsible for the light emitting from them'. The stands are all in private curtileges along a private drive, within the Act.
Don't say 'take it to court' - judiciary always support developers and their money.
Para 2.45 should therefore be reinstated.
